Orders

  1. All orders received by us through this website are subject to acceptance by us and subject to availability. If the item/s ordered are unavailable we will contact you by email or phone (if you have supplied us with your contact number) and you will have the option to either wait until the item is available or to cancel your order. (Certain products are limited to a maximum number per order. This is clearly stated on any listing this applies to. If you choose to ignore the maximum and order more, then your order will be amended by us and the difference refunded. If your order was previously over £40 and qualified for free P&P, and your amended order then is below £40, the cost of the P&P, at the time on the website, will be added.)

  2. All prices shown on our website are shown inclusive of value added tax (VAT), unless otherwise shown, at the prevailing rate. We reserve the right to change prices without prior notice.

  3. The information supplied by you when placing any order, must be accurate and true. You agree not to impersonate any other person, company or body or to use a false name.

  4. You may cancel any product and/or service within 14 days of receipt subject to any item/s being returned in their original, unused condition and in original packaging.

  5. Please refer to the separate 'Privacy Policy' for further details.

  6. Any order made by you will be treated as an 'offer to purchase' from us, a contract between us only being formed when we have accepted the order and despatched the relevant product/s to you. We reserve the right to refuse any order at any time and without providing a reason. If we cancel an order an immediate refund will be processed.

Guarantee

Products are sold with a guarantee as provided by the manufacturer and as detailed in any literature supplied with the product. Any terms and conditions relating to the product guarantee will be detailed in the literature.

Please note that many moving parts are not covered by the manufacturer's guarantee as they are deemed to be subject to "wear and tear" when in regular use. If you have any query regarding the guarantee about a product you have purchased, please get in touch and we will clarify which parts are and are not covered.

This guarantee will not apply to any product which has been modified or altered in any way; has been subject to misuse; is not properly stored, used or maintained; has been damaged by using accessories not recommended by the manufacturer; and has been damaged through normal wear and tear.

Please remember that it is the customer's responsibility to check an item over to ensure that is fully operational before each use. Checking for general wear and tear and any parts which may need adjustment or tightening (for example on a rollator or any item with moving parts) before use. 

Cancellation and Returns

If you are purchasing products as a private individual, you have the right to cancel any contract within 14 days of receipt by you (as long as the product you ordered isn't a made to order/special order/non-returnable item). The products must be returned in an unused condition and with the packaging complete and intact. You many not cancel any services once we/any relevant third party provider have started to provide the same to you.

If you do wish to cancel any order please notify us immediately by phone to our customer services department on 0161 85 00 88 4, or in writing to Customer Services, Ability Superstore, The Mill, Gertrude Street, Nelson BB9 8RS. You must then return the item/s to us with immediate effect and at your own cost, in an unused condition and with the packaging complete and intact to Ability Superstore, The Mill, Gertrude Street, Nelson BB9 8RS.

Once we have received the returned product/s in an unused condition, with complete packaging, we will then arrange for a refund of the cost of the order to be made either by sending you a cheque or by refunding the credit card you originally made the payment with. This will be made within 14 days of receipt of the return of the product/s.

If you cancel a contract and return the products stating that the product/s are faulty, and subsequently it is deemed that the products are not indeed faulty, or if the products are returned in an opened state which means we are unable to resale the item, then no refund will be provided and the product/s will be returned to you. We reserve the right to charge for packing and despatch of such items.

Payment

We can take payment for product/s via our website, on the phone and through the post. Orders over £300 cannot be taken over the phone, due to cases of fraud. You can pay by Mastercard, Visa or Maestro. You can also pay by bank transfer and by cheque. We will not despatch any product/s ordered by you until the funds have cleared in our bank account. It is your responsibility to ensure that any payment method (credit card account/bank account) is yours and you are eligible to use the same.

Occasionally the credit card issuer/bank may wish to undertake validation checks on purchases. We reserve the right to share the information relating to your order with any third parties making such validation checks.

If your payment provider refused to authorise a payment to us, we will inform you as quickly as possible. If we are unable to contact you, for any reason, we will immediately cancel your order.

Delivery

We will make delivery of any product/s ordered by you using the Royal Mail, Parcelforce, DPD or other courier, depending on the size of the item.

Many deliveries require a signature at the point of delivery, however, since the start of the Coronavirus pandemic in 2020 most couriers no longer take signatures, replacing these with GPS co-ordinates and/or photographs of the delivery point. Please note that these GPS co-ordinates and/or photographs are proof of delivery and, if the co-ordinate/photograph confirm the address location then this is proof of delivery and cannot be queried.

If no one is available to accept a delivery then a card may be left asking you to contact your local Royal Mail or courier's local office to arrange collection. It is your responsibility to arrange this collection directly in liaison with the delivery provider as appropriate.

Missing or damaged items

Please note that any shortages/damages must be confirmed within 3 working days from the date of the delivery. After this time no acceptance for missing items will be entertained.

Undelivered items

If the item you order is returned to us due to non-delivery (usually where the item is too big to go through the letterbox and there is no one in to accept the delivery, a card is left but then no attempt to collect the item from the courier's local office is made), we will contact you accordingly. If you require a second delivery to be made then an additional postage/courier charge will be made to cover the second delivery. If, at this point you request a refund, the amount refunded will be less any return costs imposed on us by the relevant courier. If an item has been sent directly from our supplier and it is returned undelivered then the refund will be less any return costs and/or restocking fees imposed.

These Terms and Conditions will not affect any statutory rights which you may have under any Act of UK Parliament and any rights which cannot be excluded by law and/or by agreement.
